The legal basics

Who owns the house in a California divorce?

California is a community property state. According to the California Courts' self-help guide on property and debts in a divorce, property and debt acquired during the marriage is generally community property, and if you can't agree on a different split, a judge will generally divide it equally. A house bought during the marriage is usually community property, and the mortgage taken out during the marriage is usually a shared debt.

It isn't always 50/50, though. A house can be part separate and part community. For example, if one spouse used money they had before the marriage for the down payment, that part may be separate property, while equity built with mortgage payments made from wages during the marriage may be community. Sorting out those numbers is a job for your attorney or mediator, and it's one more reason a clean, documented sale price helps: everyone works from the same figure.

You usually can't sell on your own once the case is filed

When a divorce is filed in California, the Family Law Summons (form FL-110) includes standard restraining orders that apply to both spouses. Among other things, they bar either spouse from transferring, borrowing against or otherwise disposing of property without the other spouse's written consent or a court order.
