What changed

California and Fresno rules every landlord should know

Being a small landlord in California is more complicated than it was even five years ago. None of this is legal advice, and you should talk to a landlord-tenant attorney about your own situation, but here are the changes we hear about most from Fresno owners who call us:

  • Statewide rent caps and just cause. The Tenant Protection Act (Civil Code 1947.12) limits yearly rent increases on many rentals to 5% plus inflation, capped at 10%, and Civil Code 1946.2 requires a "just cause" to end most tenancies after the first year. Some single-family homes owned by individuals are exempt, but only if the lease includes the required written notice.
  • Tighter "no-fault" rules. SB 567, effective April 1, 2024, added stricter conditions for owner move-in and substantial remodel terminations.
  • Lower security deposits. Since July 1, 2024, AB 12 limits most deposits to one month's rent. Smaller landlords who own no more than two properties with four or fewer units in total can still collect up to two months.
  • Longer eviction timelines. AB 2347 gave tenants 10 court days, instead of five, to respond to an eviction lawsuit, starting January 1, 2025.
  • Fresno rental registration. Under the City of Fresno's Rental Housing Improvement Program, owners must register their rental units with the city. Registration is free, but the city's FAQ lists $100 per unit for a baseline inspection and $100 for a compliance re-inspection, and unregistered properties can be fined.

Plenty of landlords handle all of this just fine. But if you've already decided the rules, the calls and the risk aren't worth it anymore, you don't have to keep going.

Keep the house and hand off the day-to-day. You keep the equity and the appreciation, but you also keep the repairs, vacancies and legal risk, and you pay a management fee every month.

List it on the market

Often the best price for a vacant, updated rental. Expect repairs before listing, showings, buyer inspections and lender appraisals, plus commissions. With tenants in place, many retail buyers won't even look.

Do a 1031 exchange

Sell and roll the proceeds into another investment property to defer capital gains tax. The IRS rules give you 45 days to identify a replacement and 180 days to close, and you need a qualified intermediary.

Don't forget the taxes

Selling a rental isn't taxed like selling your own home. The home sale exclusion generally doesn't apply unless you lived there, and the depreciation you claimed over the years is taxed when you sell. The IRS explains it in Topic 409, Capital Gains and Losses: the part of your gain from depreciation on real property (called unrecaptured Section 1250 gain) is taxed at up to 25%.
