How to stop foreclosure in Fresno, starting today

If you're behind on your mortgage, the hardest part is often opening the mail. But the sooner you act, the more ways there are to stop foreclosure in Fresno. California foreclosures follow a set legal timeline with built-in waiting periods, and at almost every step you still have the right to catch up, work out a deal with your lender, or sell the house yourself.

The short answer

  • If keeping the house doesn't make sense, sell before the sale date. A sale pays off the loan through escrow, and any equity left over goes to you instead of being lost at auction.

How foreclosure works in California

Most Fresno-area homes are financed with a deed of trust, so lenders usually foreclose outside of court through a trustee. Here is the minimum timeline under federal rules and the California Civil Code. In practice it often takes longer, and the dates on your own notices are the ones that count.

  1. Missed payments

    Federal rules generally bar the servicer from starting foreclosure until you are more than 120 days behind. In this window they must reach out about options to avoid foreclosure.

  2. Notice of Default

    The trustee records a Notice of Default with the Fresno County Recorder and mails you a copy. California then requires at least three months before a sale can be set, often the best window to sell or work out a deal.

  3. Notice of Trustee's Sale

    The notice is posted on the property, mailed and published, and sets an auction date at least 20 days out.

  4. Trustee's sale

    The house is auctioned. Your right to reinstate ends five business days before this date, so earlier is always better.

There is no single right answer. The best path depends on whether you can afford the house going forward, how much equity you have, and how much time is left before the sale.

Reinstate the loan

Pay the past-due amount plus fees and costs to bring the loan current. You can do this until five business days before the sale.

Repayment plan or forbearance

If the hardship was short term, your servicer may spread the missed payments out or pause them for a while.

Loan modification

A permanent change to your rate, term or balance. California's Homeowner Bill of Rights limits a sale while a complete application is under review.

Short sale or deed in lieu

If you owe more than the house is worth, the lender may accept less than the full payoff or take the house back without an auction.

List the house

If you have equity and time, listing can bring the highest price. A listing agreement can also postpone a scheduled sale (more below).

How selling can stop a foreclosure sale

When you sell, the buyer's money goes into escrow, the escrow company pays off your mortgage and any past-due amounts, and the foreclosure is cancelled because the loan is paid in full. Whatever is left after the payoff and closing costs is yours.

That's the big difference from an auction. At a trustee's sale you lose control of the price, and a foreclosure can stay on your credit report for up to seven years. Selling first lets you choose the price, the closing date and when you move.

Since January 1, 2025, California law (AB 2424) also gives owners of 1 to 4 unit homes more room to sell. Giving the trustee a listing agreement with a licensed real estate broker at least five business days before the sale generally postpones it at least 45 days, and a signed purchase agreement can add another postponement.
