1. Wait for the tenants to leave

Then repair, clean and list it vacant. You get the widest pool of buyers, but you may wait months for a lease to end, collect no rent while it's empty, and pay turnover costs before the first showing.

2. List it occupied

Possible, but you'll need written notice for each showing, cooperative tenants, and buyers willing to inherit a lease. Owner-occupant buyers usually pass, and lenders may still require interior appraisals.

What California law says when you sell a rental

Here's the legal landscape every Fresno landlord should know before selling a tenant-occupied house. This is general information, not legal advice, so talk to a landlord-tenant attorney about your specific lease.

The lease survives the sale

A fixed-term lease doesn't end because the property changes hands. The buyer steps into your shoes as landlord, bound by the same rent, term and conditions. Month-to-month tenancies carry over too, and ending one still requires the proper written notice.

Selling isn't "just cause" under the Tenant Protection Act

California's Tenant Protection Act (Civil Code section 1946.2) requires a listed "just cause" to end a tenancy once a tenant has lived in the home for 12 months. A sale isn't on that list. The no-fault causes, such as an owner moving in or taking the unit off the rental market, come with strict conditions and usually require relocation assistance equal to one month's rent. Some single-family homes owned by individuals are exempt, but only if the lease includes specific written notice, so check your paperwork before assuming you qualify.

Showings need written notice

Under Civil Code section 1954, you can enter to show the home to prospective buyers, but only during normal business hours and with reasonable written notice, generally 24 hours. Every showing is another notice, another interruption for your tenants, and another chance for things to go sideways.

The security deposit moves with the house

When you sell, Civil Code section 1950.5 says you either transfer the deposit to the new owner and notify the tenant in writing with the new owner's name, address and phone number, or return it to the tenant minus any lawful deductions. Fresno's rental registry

Can I sell my house in Fresno if tenants are still living there?

Yes. California law doesn't require a rental to be vacant to sell it. The lease stays in effect and the buyer becomes the new landlord. We buy tenant-occupied houses regularly, so your tenants don't need to move.

Do I have to tell my tenants I'm selling?

You don't need to tell them to get an offer. Once we schedule a walk-through, you'll give them written notice of entry, generally at least 24 hours ahead. After closing, the tenants must be told who the new owner is and where to pay rent, and we send that notice.

Can I evict my tenants because I'm selling the house?

Usually not.
